General Terms and Conditions

By ordering a Service from Lavanda Dry d.o.o. (“Company”), you accept the following General Terms and Conditions:

  1. Payment for Services The Company’s services selected on the website or in the app are paid in advance. Payment can be made by credit/debit card, Apple Pay, or Google Pay (depending on availability) through the Stripe system. Business (B2B) users can pay via bank transfer, by special arrangement. The Company reserves the right to cancel or limit its Service depending on the availability of the Company’s resources.
     

  2. Pricing Service prices, expressed in euros, are listed in the Company’s price list available on the website. The Company reserves the right to change the Service price at any time, without prior notice.
     

  3. Contacting the User To ensure better and more precise execution of the selected Service, the Company has the right to contact you as a User via phone or SMS. Once the Service is contracted, the Company may send reminders regarding the scheduled time of arrival or execution of the Service. The Company may also send other notifications suitable for users.
     

  4. Liability The Company will perform the Service with due care and will execute the Service according to professional standards and within a reasonable time. The Company will take all reasonable measures to ensure that its employees act with due care during the execution of the Service and reasonably care for the vehicle at the place where the vehicle is washed and cleaned and while it is under the supervision and care of the Company. At the same time, the Company does not assume responsibility for the following:

    1. Damage, loss of the vehicle, any of its accessories, or any other inventory of the vehicle and/or damage to any other property, arising from or in connection with the Company’s supervision of the vehicle after the Company and/or its employee has notified the User of the damage and/or after the User has taken over, inspected the vehicle, and approved the Service (without notifying the Company and/or the Company’s employee of the existence of any damage).

    2. Where it is proven that such liability arises, and only to the extent that it is proven to arise, as a result of intent or negligence, a criminal act, or any other violation of the law by the User.

    3. Furthermore, the Company does not assume responsibility for any damage, regardless of how it occurred, if the damage arises from or is in connection with the seizure of the vehicle by public authorities.

    4. If the user cannot take over and inspect the vehicle after the Lavanda Dry employee finishes washing the vehicle (e.g., the employee is instructed to leave the key at the company’s reception after washing the vehicle), the company is not responsible for any damage to the car after the employee leaves the user’s location.

The Company’s employees are not authorized to receive any valuables or other items for safekeeping, so the Company will not be liable in case of loss or damage to such items if the User has left them for safekeeping with the Company or its employees.

Users are required to store their valuables in a safe place before leaving the vehicle with the Company.

 

5. Inspection of the General Condition of the Vehicle While the User’s vehicle is under the supervision and care of the Company, the Company is authorized to inspect the general condition of the vehicle. In accordance with the Data Protection Policy, the Company’s employees are authorized to collect data about the vehicle to ensure better execution of the Service, which includes photographing the customer’s vehicle before and after the Service and conducting an inspection to determine if there are any damages or scratches.

 

6. Right to Modify the Order The User has the right to cancel the Service order. If the User cancels the order more than 1 hour before the scheduled service time, the Company will not charge for it. If the User cancels the order within 1 hour of the scheduled time, the full Service price will be charged.

7. User Responsibilities Before the start of the Service, the User is obliged to disclose to the Company and/or its employees all known or suspected defects, damages, and scratches on their vehicle that may affect the execution of the Company’s service.
 

The Company is not obliged to insure the user’s vehicle against loss while it is in its possession. The User is responsible for insuring the vehicle at all times. Complaints about the provided Service will only be considered if submitted during the Service or immediately after the user has taken over and inspected the vehicle.
 

The User will be liable to the Company for any death, injury, or damage caused to the Employee due to a defect in the User’s vehicle or any harmful or dangerous content on or within the vehicle.
 

Since the polishing agent and other cleaning agents used during the Service may be slippery, the Company recommends extreme caution by the User when taking over the vehicle. The Company assumes no responsibility for any loss or damage resulting from non-compliance with this warning.
 

Since old or non-original paint may be damaged during the cleaning process, the User must inform the Company’s employees of any such defects before the cleaning process begins.
 

The Company requests that the User reinstall child and booster seats themselves and check their safety. Under no circumstances is the Company responsible for the proper installation of these seats.

By placing an order, the User confirms to the Company that they possess a spare set of keys for the vehicle and that the Company will not be responsible for any loss or damage caused to the user or the vehicle by an employee who accidentally lost the keys or locked them in the vehicle. The Company will bear the actual cost of making a new key.

Since older vehicles may have weaker or defective materials, the Company agrees to perform the Service on vehicles older than 3 years with the User assuming the risk. The User is responsible for bringing their vehicle to a suitable and safe place where the Lavanda Dry employee can clean the vehicle without obstructing other employees in traffic or endangering the employee’s life. If the user is unable to bring the vehicle to such a place and the employee is asked to move and drive the vehicle to the service location, the Company is not responsible for any damage resulting from such an action. Any potential damage that occurs while driving the car will be covered by the user or the user’s insurance.

8. Privacy Order or payment data provided to the Company will only be used by the Company and will not be given to any other individual or organization. Other privacy rules can be found in the Company’s Data Protection Policy.

Appendix A. Explanation of Key Terms

Price List A list of prices offered at the time of the User’s order for Services provided by the Company.

Services Vehicle cleaning services offered by the Company, selected by the User.

Cleaning Process Includes vehicle cleaning services offered by the Company and selected by the User.

Company Lavanda Dry d.o.o. for services.

Employees Any worker, employee, or associate of the Company acting for or on behalf of the Company.

User A person with whom the Company has entered into a contract, including all persons reasonably believed to be acting with the User’s authority or knowledge.
